Should the United States be taken to court for going against the United Nations in their act of war against Iraq?

People can be taken to the ICJ, not countries. Just look at the fallout from the Kosovo conflict--Milosevic died in prison during his trial.

The U.S. is the only country in the world that does not adhere to the ICC and the ICJ, and don't believe that they're in their jurisdiction. However, that hasn't prevented other countries from issuing warrents. It's why Kissinger can't really travel anywhere outside of the U.S.--he'd be arrested for his Iran-Contra connections.

Did you know that the U.S. has reserved the right to invade The Hague if any Americans are put on trial for crimes against humanity?

Sad, but true. ;)

I'm going to be honest here. If the US or any major players were indicted for crimes against humanity by the UN for the war in Iraq, do you really think the US would sit down an take it? The US would stop any sort of support that it gives to the UN. The UN would be devastated by the loss of troops, money, and whatnot that the US donates. And besides, other countries like Britain would join the US in some sort of hostility against the UN.

Why be bullied around by an organization that you essentially run? That's why I think that there should be more countries on the SC and the countries should rotate leadership every couple of years. But that's for another discussion...
